
Terms & Conditions
Effective date: May 1, 2025. Please read these terms carefully before engaging our services.
1. Agreement to Terms
By requesting an estimate, signing a contract, or engaging Golden Valley Paving Inc ("Company," "we," "us," or "our") for any paving, asphalt, seal coating, or related services, you ("Client" or "you") agree to be bound by these Terms and Conditions. If you do not agree, please do not engage our services.
2. Services
Golden Valley Paving Inc provides commercial, industrial, and residential paving services including but not limited to: asphalt paving and installation, asphalt cutting and removal, asphalt repair and patching, seal coating, chip sealing, and parking lot paving, primarily serving Fresno, CA and the surrounding Central Valley.
All services are subject to a written scope of work agreed upon prior to commencement. Any work outside the agreed scope requires a written change order signed by both parties before additional work begins.
3. Estimates and Quotes
Free estimates provided by Golden Valley Paving Inc are based on conditions observed at the time of inspection and information provided by the Client. Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.
An estimate is not a binding contract. Work does not commence until a written agreement or work order has been signed by an authorized representative of both parties. Final pricing may differ from the estimate if site conditions, material costs, or project scope change after the estimate is issued.
4. Payment Terms
Payment terms are specified in the written work agreement. Standard terms are:
- A deposit may be required prior to scheduling, as specified in the agreement.
- Final payment is due upon completion of work and Client walkthrough, unless otherwise agreed in writing.
- Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month on the outstanding balance.
- Client is responsible for all collection costs, including reasonable attorney's fees, if payment is not received.
We accept cash, check, and electronic payment. Returned checks are subject to a $35 returned check fee.
5. Project Access and Site Conditions
Client agrees to provide Golden Valley Paving Inc and its crew with safe, unobstructed access to the work area for the duration of the project. This includes removing vehicles, equipment, and personal property from the work area prior to the scheduled start date.
Client is responsible for notifying tenants, employees, or other occupants of the work schedule and access restrictions. Golden Valley Paving Inc is not liable for delays caused by inaccessible work areas.
Client represents that all underground utilities, irrigation lines, and obstructions within the work area have been marked or disclosed prior to work commencement. Golden Valley Paving Inc is not liable for damage to unmarked underground utilities or undisclosed obstructions.
6. Weather and Scheduling
Asphalt paving and seal coating are weather-dependent services. Golden Valley Paving Inc reserves the right to reschedule work due to rain, extreme temperatures, high winds, or other weather conditions that would adversely affect the quality or safety of the work. We will make reasonable efforts to notify Client of schedule changes as early as possible.
Weather-related delays do not constitute a breach of contract and do not entitle Client to a reduction in price or termination of the agreement.
7. Curing and Post-Work Instructions
New asphalt requires a curing period before it reaches full strength. Client is responsible for following all post-installation instructions provided by Golden Valley Paving Inc, including:
- Keeping vehicles off new asphalt for the recommended period (typically 24–72 hours for standard traffic, longer for heavy vehicles).
- Avoiding sharp objects, vehicle turning in place, and heavy concentrated loads during the curing period.
- Following seal coat dry time instructions before allowing traffic or pedestrian access.
Damage caused by failure to follow post-work instructions is not covered under any warranty provided by Golden Valley Paving Inc.
8. Workmanship Warranty
Golden Valley Paving Inc warrants that services will be performed in a workmanlike manner using materials suitable for the intended application. Any specific warranty terms will be stated in the written work agreement.
Warranty claims must be submitted in writing within the warranty period. Warranty does not cover:
- Damage resulting from Client's failure to follow post-work care instructions.
- Normal wear and tear, including surface cracking due to thermal expansion and contraction.
- Damage caused by tree roots, underground movement, or pre-existing sub-base conditions not disclosed prior to work.
- Damage from chemical spills, fuel leaks, or other corrosive substances.
- Acts of nature including flooding, earthquake, or extreme freeze-thaw cycles.
9. Limitation of Liability
To the maximum extent permitted by California law, Golden Valley Paving Inc's total liability to Client for any claim arising from or related to our services shall not exceed the total amount paid by Client for the specific services giving rise to the claim.
Golden Valley Paving Inc is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, regardless of the cause of action.
10. Insurance and Licensing
Golden Valley Paving Inc maintains general liability insurance and workers' compensation insurance as required by California law. Proof of insurance is available upon written request. Golden Valley Paving Inc holds all applicable contractor licenses required to perform the services described.
11. Cancellation and Termination
Either party may cancel a scheduled project with at least 48 hours written notice prior to the scheduled start date without penalty. Cancellations with less than 48 hours notice may result in a cancellation fee equal to any mobilization costs incurred by Golden Valley Paving Inc.
If Client cancels after work has commenced, Client is responsible for payment for all work completed and materials purchased to that point, plus reasonable demobilization costs.
12. Dispute Resolution
In the event of a dispute, the parties agree to attempt resolution through good-faith negotiation first. If negotiation fails, disputes shall be resolved through binding arbitration in Fresno County, California, under the rules of the American Arbitration Association, unless the amount in dispute is within the jurisdictional limit of California Small Claims Court.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings shall be brought in Fresno County, California.
14. Website Use

15. Changes to These Terms
Golden Valley Paving Inc reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued engagement of our services after changes are posted constitutes acceptance of the updated terms.
